These Terms and Conditions (the “Terms”) set  out the rules and regulations regarding the use of the Danielle Elaine Photography website (the “Site”). By visiting the  Site, you acknowledge that you have read, understood, and agree to these Terms without limitation or qualification. Please read the Terms carefully before using the Site. Your use of the Site means that you  agree to and are bound by any changes. All changes, revisions, and modifications of the Site may occur  with or without notice. This Site is operated by Love from the Table, LLC, d/b/a Danielle Elaine Photography ("Danielle Elaine Photography" or the “Company”). Throughout the  Site, the terms “we,” “us,” and “our” refer to the Company. These Terms apply to all users, including  browsers, customers, vendors, and contributors of content. This Site and its accompanying services are hosted through Shopify Inc. Please see our Privacy Policy for more details. 

SECTION 1- ONLINE TERMS 

You represent, in agreeing to the Terms, that you are at least the age of majority where you live and  where you use this Site. If you are not the age of majority, you may only access or use the Site under  the supervision of a parent or legal guardian who agrees to be bound by these Terms. You shall not use  any product or service obtained from the Company for any illegal or unauthorized purpose (including,  but not limited to, copyright laws). You agree not to reproduce, copy, sell, or exploit any portion of the  Site or any item sold by the Company. The Company reserves the right to immediately terminate your use of the Site if you are found to be in breach of any of the Terms. 

SECTION 2- ORDERS AND RETURNS 

The Company reserves the right to refuse, cancel, or limit service to anyone for any reason at any time.  We reserve the right to limit sales to any person, region, or jurisdiction. If we change or cancel an order, we will attempt to notify you by email using the email provided by you on your order. We reserve the  right to limit the quantities of products offered. We have made every effort to display our products as  accurately as possible. However, we cannot guarantee the accuracy of any product on the Site. 

For all purchases made from the Site, you agree to provide current and complete information and to  promptly update this information if changed. The Company is not liable for any failure to deliver  products or give timely notice due to inaccurate, incomplete, or undeliverable information. We  maintain the right to suspend or cancel your order if your payment method cannot be verified, is invalid,  or is otherwise not acceptable. You represent and warrant that you have the right to use any payment  method(s) in connection with any purchase, and it is your sole responsibility to secure said right. Any  problem associated with your payment method is your sole responsibility to resolve in order to proceed  with your order. 

Prices, unless clearly stated otherwise in writing, are not inclusive of applicable taxes and other potential charges. Prices, descriptions, and product availability are subject to change at any time without notice.  The Company shall not be liable for any change. We reserve the right to modify, pause, or discontinue  any product without notice.

In purchasing from the Site, you agree to pay all shipping and handling charges shown at the time of  purchase. We reserve the right to modify shipping and handling charges at our sole discretion. All  delivery dates and times are estimates and are not guaranteed. 

Any promotions available on the Site may be governed by rules independent from the Terms. It is your  responsibility to ensure your eligibility for any promotion. Failure to comply with any rules governing  the promotion will result in disqualification from the promotion at our sole discretion.  

Due to the nature of our products, we cannot accept returns. All sales are final.

SECTION 3- INFORMATION AND MODIFICATIONS 

The Company is not responsible for the accuracy or completeness of any information on the Site. The  information on the Site is for general education purposes only and should not be relied upon as the sole  basis for any decisions. We reserve the right to modify the Site at any time, with or without notice.  Therefore, you agree that it is your responsibility to monitor the Terms for any changes or updates. 

Prices, description, ingredient lists, and product availability are subject to change at any time without  notice, and the Company shall not be liable for any change. We reserve the right to modify, pause, or  discontinue any product without notice.  

On occasion, there may be information on the Site that has been made in error. We reserve the right to  correct any errors associated with the Site and the services we provide at any time, without prior notice. 

We may, but have no obligation to, monitor or remove comments or reviews that, in our sole discretion,  we deem unlawful, offensive, threatening, or otherwise objectionable, illegal, or in violation of the  Terms or our Privacy Policy. You agree that any comment or review you make will not violate any rights  of any party, nor will contain unlawful, abusive, or obscene material. You are solely responsible for any  reviews or comments made by you; The Company assumes no liability or responsibility for any reviews  or comments made by any user of the Site. 

SECTION 4- THIRD-PARTY VENDORS 

Danielle Elaine Photography uses third-party vendors to deliver our products and power the Site, among other  services. Therefore, you acknowledge and agree to use these vendors as is. Danielle Elaine Photography shall have  no liability arising from or relating to your use of these vendors. 

Danielle Elaine Photography uses Shopify to complete, process, and fulfill your order. Therefore, you acknowledge  and agree to use these services as is. All payment processors use and maintain independent terms of service and privacy policies. By completing an order or creating an account, you  agree to all such policies, as well as any reasonable fees associated with processing your order. Danielle Elaine Photography is not liable for any breach of the terms of service and privacy policies of our third-party  processors. Please review Shopify’s terms of service and privacy policies before completing your  order, as they may differ from those of Danielle Elaine Photography.  

SECTION 5- EMAIL LIST AND ACCOUNTS 

If you choose to create an account on the Site, you will create a username and password. It is your responsibility to ensure the confidentiality of this information. The Company shall not be responsible for any loss or damages due to breaches stemming from inappropriate or negligent use of your  username or password. In creating an account, you agree to provide true and accurate information. If  you are found in violation of the Terms, we may terminate your account without notice. We reserve the  right to terminate your account for any reason in our sole discretion without notice. 

Danielle Elaine Photography may ask for your email and other identifying information to participate in our email  newsletters. If, at any point, you wish to stop receiving emails, please use the unsubscribe function  found at the bottom of the email to remove your email from our listserv. If you continue to receive  emails from us after unsubscribing, please email us at danielleelainephoto@gmail.com.  

SECTION 6- DISCLAIMER OF WARRANTIES AND LIABILITY LIMITATIONS 

Danielle Elaine Photography cannot guarantee that your use of the Site will be uninterrupted, accurate, reliable,  secure, or otherwise error-free. You agree that your use of the Site and purchase of any products is at  your sole discretion and risk.  

SECTION 7- INDEMNIFICATION 

You agree to indemnify, defend, and hold harmless Danielle Elaine Photography from any claim or action, including  attorneys’ fees, made by any person due to or arising from your breach of the Terms. Your sole and  exclusive remedy, and the Company’s sole and exclusive liability, for any breach of warranty by the  Company shall be your right to receive a replacement product as provided by the Company’s  return policy. 

SECTION 8- SEVERABILITY 

If any section of the Terms is determined to be unlawful, void, or unenforceable, that section shall be  deemed severed from the Terms and not affect the validity of any other sections of the Terms.  

SECTION 9- TERMINATION 

The obligations and liabilities set forth in the Terms shall survive the termination of the Terms for all  purposes. You may terminate the Terms at any time by ceasing to use the Site and closing your account.  We, in our sole judgement, may terminate your right to use the Site or any portion thereof, and/or to  block or prevent your future access to and use of the Site or any portion thereof, without notice at any  time.

SECTION 10- ENTIRE AGREEMENT 

Any failure to exercise or enforce any provision of the Terms shall not constitute a waiver of any right or  provision. The Terms and any other policies posted by us on the Site constitutes the entire agreement,  superseding any prior or contemporaneous agreements and communications, written or oral. 

SECTION 11- GOVERNING LAW 

The Terms and any other agreements provided to you shall be governed by the laws of the state of  Wisconsin.
